Small Claims

Small Claims Court is for cases involving claims for damages not exceeding $8,000.00.  The filing fees are based on the amount of the law suit.  Please see the below fee schedule.

For claims: Filing Fee
Less than $100.00 $55.00
$100.00 to $500.00 $80.00
$500.01 to $2,500.00 $175.00
$2,500.01 to $8,000.00 $300.00

There is an additional fee of $10.00 for each summons issued.

 

The Seminole County Sheriff’s Office will serve the summons if the address is located in Seminole County.  Their fee is $40.00 per each summons.

What is Small Claims Court?

 

When a Small Claims Case is filed, it is automatically set on a Pre-Trial Conference docket for the Court.  At this court date, the parties will be sent to mediation to see if the issue can be resolved that day.  If the case is not settled at mediation, it will be up to the Judge whether to set it for trial or how the case will proceed from there.
